The City of Charleston Municipal Court sets bonds for criminal charges prosecuted in its court. Bond proceedings occur twice daily:
Monday through Friday: 9:00am and 2:00pm
Saturdays, Sundays, and holidays: 8:30am and 10:30am
At the bond hearing:
- The defendant will be advised of their legal rights.
- The nature of the charges and
- All potential penalties.
- Defendants may have an attorney represent them at the bond hearing.
- Victims have a right to be present at bond hearings and advise the court of any concerns related to the matter of release.
Each defendant is entitled to a personal recognizance bond, unless the court determines that such release will not assure their appearance in court and/or they pose an unreasonable danger to the community.
Upon such a determination, the court may set a surety bond not to exceed the maximum fine amount associated with the criminal charge.
